1. Acceptance of Terms
By accessing or using the facilities and services of Peak Play Pty Ltd (trading as Peak Play Sports Centre) (hereinafter referred to as "the Centre"), all users, members, and visitors (collectively referred to as "Participants") agree to comply with and be bound by the following Terms and Conditions. If you do not agree with these terms, please refrain from using our facilities and services.
Peak Play Pty Ltd reserves the right to change these rules and regulations from time to time and to make, vary, and revoke any by-laws which may be considered necessary or desirable for the regulation and conduct of Participants.
2. Definitions
Participant: Any individual utilizing the Centre's facilities or services, including members, guests, and visitors.
Member: An individual who has completed the membership registration process and has paid the applicable fees.
Guest: A non-member accompanying a Member, attending specific events or sessions.
3. Membership
3.1 Eligibility: Membership is open to individuals of all skill levels, subject to the Centre's approval.
3.2 Application: Prospective members must complete the membership application form and pay the required fees. The Centre reserves the right to accept or reject applications at its discretion.
3.3 Fees: Membership and other applicable fees are detailed on our official website and are subject to change. Members will be notified of any fee adjustments in advance.
3.4 Termination: The Centre reserves the right to suspend or terminate memberships without refund for violations of these Terms and Conditions or any conduct deemed detrimental to the Centre or its Participants.
4. Facility Usage
4.1 Bookings: Courts and facilities must be booked in advance. Participants must adhere to their allocated time slots and court assignments to avoid additional charges.
4.2 Attire: Appropriate sports attire, including non-marking footwear, is mandatory on the courts.
4.3 Conduct: Participants are expected to maintain respectful behaviour. Any form of misconduct, harassment, or damage to property may result in fees to repair the damage, fines, suspension, termination of access, or other reasonable penalties.
4.4 Coaching: Only coaches authorized by the Centre are permitted to provide coaching or lessons within the Centre. Unauthorized coaching is strictly prohibited.
5. Safety and Liability
5.1 Assumption of Risk: Participants acknowledge that engaging in physical activities carries inherent risks. Participation is voluntary, and individuals assume all associated risks.
5.2 Medical Clearance: Participants are advised to seek medical clearance before engaging in strenuous activities, especially if they have pre-existing conditions.
5.3 Liability Waiver: The Centre is not liable for any injuries, damages, or losses incurred while using the facilities, except where caused by the Centre's gross negligence.
6. Bookings and Cancellations
6.1 Reservations: Bookings can be made through our official website or at the Centre. Full payment is required to confirm a reservation.
6.2 Cancellations: Cancellations must be made at least 24 hours in advance to receive a refund. Late cancellations or no-shows may result in forfeiture of fees.
7. Facility Maintenance and Closures
7.1 Maintenance: The Centre reserves the right to close certain areas for maintenance, repairs, or upgrades. Notices will be provided in advance whenever possible.
7.2 Force Majeure: The Centre is not liable for closures due to events beyond its control, such as natural disasters, pandemics, or governmental restrictions.
8. Personal Property
Participants are responsible for their belongings. Peak Play Pty Ltd is not liable for lost, stolen, or damaged personal items.
9. Parking and Vehicle Liability
9.1 Use of Parking Facilities: Parking spaces at Peak Play Sports Centre are provided for the convenience of Participants. Vehicles must be parked only in designated parking spaces and must not obstruct traffic, emergency access points, or other vehicles.
9.2 No Liability for Damage, Loss, or Theft: Peak Play Pty Ltd, its employees, and agents accept no responsibility or liability for any loss, theft, or damage to vehicles (including motorbikes, bicycles, or other personal property) parked or left on the premises, whether in a designated parking space or otherwise. Parking on the premises is entirely at the owner's risk.
9.3 Improper Parking: Vehicles parked outside of designated spaces may be subject to warnings, towing at the owner's expense, or refusal of future parking privileges. Owners are solely responsible for any damage caused by their vehicles as a result of improper parking.
9.4 Indemnity: By parking on the premises, Participants agree to indemnify and hold harmless Peak Play Pty Ltd against any claims, demands, or legal actions arising from damage, theft, or accidents involving their vehicle while on site
10. Supervision of Minors
10.1 Children under the age of 16 must be accompanied and supervised by a parent, guardian, or responsible adult at all times while on the premises.
10.2 Peak Play Pty Ltd is not responsible for the safety or supervision of unsupervised minors.
10.3 For school or group bookings, accompanying teachers or supervisors are responsible for the conduct, safety, and headcount of their group at all times.
11. Prohibited Conduct and Substances
11.1 Participants must not bring or consume alcohol, illegal drugs, or hazardous substances on the premises.
11.2 Entry may be refused to anyone under the influence of drugs or alcohol.
11.3 Weapons, dangerous items, and any behaviour that threatens the safety of others are strictly prohibited and may result in immediate removal and notification of authorities.
12. Damage to Property
Participants are financially responsible for any damage caused to the Centre’s property, equipment, or facilities as a result of negligence, misuse, or intentional actions. The Centre reserves the right to recover repair or replacement costs.
13. Emergency Procedures
All Participants must comply with any emergency instructions issued by Centre staff, including evacuation procedures. Failure to follow such instructions may result in removal from the premises.
14. Photography and Filming
14.1 Photography and video recording by Participants is only permitted for personal use and must not infringe upon the privacy or safety of others.
14.2 Commercial photography or filming requires prior written consent from Centre management.
14.3 By attending events or sessions, participants consent to the reasonable use of photographs or videos by Peak Play Pty Ltd for promotional purposes unless otherwise requested in writing.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Victoria..
